These Terms constitute a legally binding agreement between you ("Customer," "you," or "your") and FixMiles ("we," "us," or "our").
Please read these Terms carefully before using our services. If you do not agree with any part of these Terms, you must not access our website or use our services. We reserve the right to update these Terms at any time, and your continued use of our services constitutes acceptance of any revised Terms.
These Terms should be read in conjunction with our Privacy Notice, which describes how we handle your personal information and is incorporated herein by reference.
FixMiles provides auto warranty plans designed to help vehicle owners manage unexpected repair costs. Our services include providing access to mechanical breakdown protection, coordinating with repair facilities, and supporting customers through the claims process.
Our coverage plans may include protection for:
- Engine and powertrain components including transmission and drivetrain.
- Electrical systems and advanced electronics.
- Heating and air conditioning systems.
- Fuel system components and delivery mechanisms.
- Steering and suspension components.
- Brake system components as specified in your selected plan.
The specific scope of coverage, applicable deductibles, and plan limits are detailed in your individual service contract provided at the time of enrollment. In the event of any conflict between these Terms and your individual service contract, the terms of your service contract shall govern with respect to coverage specifics.
To be eligible to enroll in a FixMiles auto warranty plan, you must meet the following requirements:
- You must be at least 18 years of age and a legal resident of the United States.
- The vehicle to be covered must be registered in your name or in the name of your household.
- The vehicle must meet the mileage and age criteria specified in the plan you select at the time of enrollment.
- The vehicle must be in proper working condition at the time of enrollment with no pre-existing known mechanical issues.
- Certain vehicle types, including commercial vehicles, salvage-titled vehicles, and vehicles used for ride-share or delivery services, may be ineligible for coverage.
- You must provide accurate and complete information during the enrollment process.
We reserve the right to verify eligibility at any time and to decline coverage or void a plan if eligibility requirements are found to have been misrepresented.
Your auto warranty plan begins upon successful completion of the enrollment process and receipt of your first payment. Enrollment requires you to provide accurate vehicle information, personal identification, and valid payment details.
Important enrollment terms include:
- Waiting Period: Most plans include a 30-day or 1,000-mile waiting period after activation before coverage begins. Claims submitted during this period will not be honored unless otherwise specified in your service contract.
- Vehicle Inspection: We reserve the right to require a pre-enrollment vehicle inspection before activating coverage on certain plans or vehicle types.
- Confirmation: You will receive a written confirmation of your enrollment and coverage details by email. Please review this document carefully and contact us immediately if any information is incorrect.
- Transferability: Coverage may be transferable to a subsequent owner of the covered vehicle, subject to a transfer fee and approval. Contact us for details.
FixMiles warranty plans cover mechanical failures of listed components due to defects in materials or workmanship. Coverage is subject to the terms, conditions, and limitations of your specific service contract.
The following are generally excluded from coverage across all plans:
- Damage resulting from accidents, collisions, theft, vandalism, or acts of nature.
- Pre-existing conditions known to exist prior to enrollment.
- Routine maintenance items such as oil changes, filters, spark plugs, and brake pads.
- Damage caused by misuse, abuse, neglect, or failure to follow manufacturer maintenance schedules.
- Cosmetic damage including paint, trim, upholstery, and glass.
- Modifications or aftermarket parts not approved by the manufacturer.
- Tires, wheels, and alignment.
- Damage from overheating due to continued operation after a warning light or symptom appeared.
Your service contract will contain a complete list of covered components and exclusions specific to your plan tier. We encourage you to review your service contract thoroughly before activating your coverage.
In the event of a covered mechanical breakdown, you must follow the claims process outlined below to ensure your repair is processed and reimbursed appropriately.
- Contact Us First: Before authorizing any repair, contact FixMiles at +1 (318) 246-7336 or juan@fixmiles.com to initiate a claim. Repairs authorized without prior approval may not be covered.
- Choose a Repair Facility: Take your vehicle to a licensed repair facility of your choice. We work with facilities nationwide.
- Diagnosis: The repair facility will diagnose the issue and provide an estimate. We may require an independent inspection to verify the claim.
- Authorization: Once the claim is approved, we will issue authorization to the repair facility for covered repairs up to the limits of your plan.
- Deductible: You are responsible for paying any applicable deductible as specified in your service contract.
- Reimbursement: In cases where you pay out of pocket for an approved covered repair, submit receipts and claim documentation for reimbursement within 30 days of the repair.
We reserve the right to deny claims that do not comply with the claims process, are not covered under your plan, or involve fraud or misrepresentation.
By enrolling in a FixMiles warranty plan, you authorize us to charge your designated payment method for the plan fees as agreed at enrollment. Payment terms include:
- Plan fees may be charged as a single payment, monthly installments, or annual payments depending on the plan option you select.
- Recurring payments will be automatically charged on the same day each billing cycle unless you cancel in advance.
- You are responsible for ensuring your payment information remains current and valid. Failure to maintain valid payment information may result in coverage suspension.
- If a payment is declined, we will attempt to notify you and allow a grace period to update payment details before suspending coverage.
- All fees are stated in U.S. dollars and are non-refundable except as provided under our Cancellation Policy.
We reserve the right to adjust plan pricing upon renewal. You will be notified of any price changes at least 30 days before they take effect.
You may cancel your FixMiles warranty plan at any time by contacting us. The following terms apply to cancellations:
- Free Look Period: You may cancel within 30 days of enrollment for a full refund of any amounts paid, provided no claims have been made.
- Cancellation After 30 Days: You will receive a pro-rated refund of the unused portion of your plan, less a cancellation processing fee as specified in your service contract.
- Cancellation with Claims: If a claim has been paid, the refund amount may be reduced by the value of any claims paid out under your plan.
- We Reserve the Right to Cancel: FixMiles may cancel your plan for non-payment, fraud, misrepresentation, or other violations of these Terms. In such cases, you will receive written notice and any applicable pro-rated refund.
To initiate a cancellation, contact us by phone or email. Cancellations are effective upon our receipt of your request and confirmation.
To the fullest extent permitted by applicable law, FixMiles, its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or related to your use of our services or your auto warranty plan.
Our total liability to you for any claim arising from your use of our services or your warranty plan shall not exceed the total amount of plan fees paid by you in the twelve months preceding the claim.
We do not warrant that our services will be uninterrupted, error-free, or free from viruses or other harmful components. We make no warranties, express or implied, regarding the accuracy or completeness of any information on our website.
Some jurisdictions do not allow the exclusion or limitation of certain warranties or liability, so some of the above limitations may not apply to you.
In the event of a dispute arising out of or relating to these Terms or your use of FixMiles services, the parties agree to first attempt to resolve the dispute through good-faith negotiation.
If a dispute cannot be resolved through negotiation within 30 days, it shall be submitted to binding arbitration in accordance with the rules of a recognized arbitration association. The arbitration shall take place in Monroe, Louisiana, unless both parties agree to a different location or virtual proceeding.
- Each party shall bear their own costs of arbitration unless the arbitrator determines otherwise.
- The arbitrator's decision shall be final and binding on both parties.
- You agree to waive any right to participate in a class action lawsuit or class-wide arbitration against FixMiles.
- Nothing in this section prevents either party from seeking emergency injunctive relief in a court of competent jurisdiction.
These Terms of Services shall be governed by and construed in accordance with the laws of the State of Louisiana, without regard to its conflict of law provisions.
Any legal proceedings not subject to the arbitration clause above shall be brought exclusively in the state or federal courts located in Ouachita Parish, Louisiana, and you hereby consent to the personal jurisdiction of such courts.
If any provision of these Terms is found to be unenforceable or invalid under applicable law, that provision shall be modified to the minimum extent necessary to make it enforceable, and the remaining provisions shall continue in full force and effect.
